I was just thinking, if the league had slapped the Devils not just with a $3MM fine but with a $3MM cap penalty (which they had obviously intended to do until the NHLPA negotiated their way out of it on Lou's behalf), would the Devils now be down to two lines and a couple of spares, like my old beer league team? Or would it be three full lines and two pairs of D, like my Squirt team?

Bonus: when's the last time you saw a team sign a free agent (Adam Mair) and then not be able to put him on the roster, because they can't afford to?

Over at Puck Daddy, Wysh points out that Ralston’s contract is also a contributing factor to The Troubles. I think that’s fair; he is very much overpaid given his age and real value. Not only is his cap hit this year comparable to IK’s, but even without his NMC it would be impossible to trade him without taking junk contracts in return.

Rolston’s overpaid, Zubrus is way overpaid. I’d say Arnott is overpaid too. Oh and don’t forget Parise is an RFA at season’s end and will demand at least $6mm.

True. There’s just this mentality for teams that have the luxury of spending to the ceiling that they can make big signings and move pieces later to make room. Obviously that tactic doesn’t work too well with Chicago selling off half their team, Redden in the minors, and now NJ icing 3 lines. It’s ridiculous.

Yeah, I was going to say....

I don’t think Dean needs the negative example of Chicago; I think he understood this quite well at least as far back as Cammalleri’s arbitration. Except he kind of approached it from the opposite end, from setting precedents in terms of young players’ salaries, rather than veteran UFAs’ salaries.

How can they sign a player but not put him on the roster? Why doesn’t that count against the Cap?

If you don’t already know, please don’t go looking it up in the CBA. I could probably do that myself, but figured if someone already knows then it makes more sense to ask. Thanks guys.

They sent down Pierre-Luc Letourneau-Leblond ($525,000) and he cleared waivers. Mair will be in the lineup on Wednesday, giving NJ 16 skaters.

Yes but Mair wasn’t officially signed until Wednesday morning. The claim that they signed a player but did not put him on the roster is incorrect. Mair was practicing with the team without a contract.

They’re screwed and if they want to ice a full team they’re going to have to move a play they don’t want to lose for little to nothing in return. You can’t expect to have 3 1st line LW and not lose someone you’d rather keep. We’ll take Langenbrunner for a 3rd :)

yes, he has an over-35 contract, but that doesn't effect the fact that

if he’s on LTIR his cap hit doesn’t come off the books but they are allowed to exceed the cap by the amount of his cap hit in order to replace him.

The problem comes when it’s time to activate the player. They have to get below the cap.

How all the announcers on the NHL HomeIce SiriusXM are defending Sweet Lou’s decision to keep the roster low as a Cap solution. Now, they are saying that the NHLPA will look into the actions of the Devils as a potential Cap circumvention…

Not that the NHLPA’s actions will amount to a hill of beans in a bean factory.

I wouldn’t be so quick to say this now that Donald Fehr has been brought into the NHLPA organization. I believe the NHLPA might have a valid point here – Kovalchuk’s inflated contract and NJ’s subsequent diminished roster size is circumventing the cap and costing three regular NHLPA members their jobs.

NHLPA can launch an investigation into a possible circumvention

This is the now famous Article 26 investigation clause. The league then is free to conduct their own simultaneous investigation. After the investigators decide they have reached a conclusion, everyone gets together to talk it out. The league and the NHLPA (not the Devils). This is intended as mediation, but I find it remarkable/hilarious that in essence the league and the union could be on the same side, with no-one representing the interests of the Devils. We should probably save that for another day. They can resolve the situation in that meeting, and in effect agree that a circumvention has taken place at which point it goes to Bettman for penalties. Since it’s an Article 50 violation, the maximum penalties apply. And as we saw in Kovalchuk v. The World, the league and union can decide to barter to reach a new agreement with new penalty guidelines, if they so choose.

Right now, the league has said they aren’t interested in pursuing this. Unless I missed some late breaking news. They let Calgary alone under similar circumstances a couple of years ago. But if they so chose, they could assess penalties that would be devastating.

As far as mid-season and whatnot, they can conduct (and conclude) an investigation at any time. As soon as there is an agreement or a ruling, the club must immediately comply. There’s nothing restricting these matters to off-season. In fact, the system is designed to expedite matters with the understanding that they’re just as likely to occur mid-season as not.

Wait till this year.

That would also put the NHLPA in the comically awkward position of pressing for sanctions against a team that is in salary cap trouble largely because of a contract that it helped that team defend against the League late this summer.

That also presumes that the NHLPA actually cares about its marginal/journeyman members, and I’m not at all certain that it does. No professional sports players union really does.

It means that one could not happen without the other. Essentially, they wouldn’t be in this situation now had they not signed Kovalchuk. They were technically already punished for that situation (although it was a different contract, so actually they could consider this a different offense).

It’s the opposite of “mutually exclusive.”

…The only thing to add, though, would be that there is a new injured party/parties, i.e.: the New Jersey Devils players not receiving moneys they would be paid at the NHL level.

The first infraction was against the League; this one is against a specific group of other players.

You’re right. Although both the league and NHLPA could impose some type of punishment, it’s the NHLPA that has more of an issue in this circumstance.

I really like how dumb Lou looks right now. I almost think he backed himself into a corner by giving up a ton for a rental (which didn’t get them anywhere in the playoffs) now instead of cutting his losses he signed Kovi to save face almost. If Parsie can’t be kept next year I will love it.
